Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Prime Pump app and related services (the "Service") provided by Prime Pump ("we," "us," or "our"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, you may not access or use the Service.

You must be at least 14 years old to use the Service. By using the Service, you represent that you meet this requirement and that you have the legal capacity to enter into these Terms. If you are using the Service on behalf of an organization, you represent that you are authorized to bind that organization.

You must provide a valid email address and password to create an account, or you may sign in using your Google account. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account.

You agree to provide accurate, current, and complete information when creating your account and updating your profile, including body metrics such as height, weight, age, and gender, as inaccurate information may affect the quality of your recommendations.

Prime Pump provides adaptive workout plans, nutrition guidance, recovery recommendations, and tracking tools for workouts, nutrition, water, and body metrics. The Service generates recommendations based on your daily check-ins, body metrics, and activity history.

We may modify, suspend, or discontinue any part of the Service at any time. We are not liable to you for any such changes.

Recommendations provided by Prime Pump are generated by a combination of rules-based algorithms and third-party AI services, and are intended for general fitness and wellness purposes only. When you use AI-powered features such as the Meal Coach, calorie burn estimation, or food label scanning, your input data is sent to third-party AI providers for processing. These recommendations are not medical advice, diagnosis, or treatment, and should not replace the guidance of a qualified healthcare professional.

You assume all risk of injury or harm resulting from your use of any workout, nutrition, or recovery recommendation. You are solely responsible for determining whether any activity is appropriate for your physical condition and circumstances.

Prime Pump offers a subscription that begins with a 7-day free trial. To start the trial, you must provide valid payment information. The trial is free for seven days. At the end of the trial period, your subscription automatically converts to a monthly recurring subscription at the then-current rate (e.g., $19.99/month) until canceled.

• Subscriptions renew automatically each month until you cancel.
• Payment is processed by Stripe at the start of each billing cycle.
• If you cancel during the free trial, you will not be charged.
• If you cancel after the trial, you retain access until the end of the current paid period.

We may change subscription fees upon reasonable notice. Price changes take effect at the start of your next billing cycle following notice.

You can cancel your subscription at any time. Cancellation stops future renewals but does not refund the current paid period. Refunds are issued at our discretion in cases of billing errors or as required by applicable law. To request a refund, contact us at primepump.app@gmail.com.

You retain ownership of the information you submit, including body metrics, workout logs, and nutrition entries. You grant us a limited license to use your data solely to provide and improve the Service and to generate your personalized recommendations.

You can clear your locally stored data at any time from the Profile screen. This removes your locally stored fitness data from your device and signs you out of the Service. Your backend account and subscription records may remain; contact us to request full deletion of backend data.

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms.
• Attempt to access another user's account or data without authorization.
• Interfere with or disrupt the Service, its servers, or its security features.
• Reverse engineer, decompile, or disassemble any part of the Service.
• Use the Service in a manner that could damage, disable, or impair it.

The Service, including its design, features, and content (excluding your personal data), is owned by Prime Pump and protected by intellectual property laws. These Terms do not grant you any right to use our trademarks, logos, or branding without prior written consent.

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that recommendations will be accurate, safe, or suitable for you. Your use of the Service is at your sole risk.

To the maximum extent permitted by law, Prime Pump and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, health, fitness, or profits, arising out of or related to your use of the Service, even if advised of the possibility of such damages.

You agree to indemnify and hold harmless Prime Pump and its affiliates from any claims, damages, or expenses arising out of your use of the Service, your violation of these Terms, or your infringement of any third-party rights.

Please read this section carefully — it affects your legal rights.

Except for disputes that may be resolved in small claims court, any dispute or claim arising out of or relating to these Terms or your use of the Service shall be resolved by binding, individual arbitration rather than in court. You and Prime Pump each agree to waive the right to participate in a class action lawsuit or class-wide arbitration.

• Class Action Waiver: You and Prime Pump agree that each party may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person's claims and may not otherwise preside over any form of a representative or class proceeding.
• Arbitration Process: Arbitration shall be conducted by a single arbitrator under the rules of the American Arbitration Association (AAA) in the United States. The arbitration shall take place in the state in which Prime Pump operates. The arbitrator's decision shall be final and binding, and judgment may be entered in any court of competent jurisdiction.
• Governing Law: These Terms and any arbitration shall be governed by the laws of the United States and the state in which Prime Pump operates, without regard to conflict-of-law principles.
• Opt-Out Right: You have the right to opt out of this arbitration agreement by sending a written notice to primepump.app@gmail.com within 30 days of first accepting these Terms. Your opt-out notice must include your name, email address, and a clear statement that you wish to opt out of arbitration.
• Exceptions: Either party may bring a claim in small claims court. We may seek injunctive or equitable relief in court to protect our intellectual property or confidentiality obligations at any time.

We may update these Terms from time to time. We will post the updated Terms in the app and revise the "Last updated" date. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

You may delete your account at any time from the Profile screen. This feature clears all locally stored Prime Pump data from your device and signs you out. Your backend account and subscription records may remain after this action. Subscription cancellation is separate; to stop recurring charges, cancel your subscription through Stripe or by contacting us before using the delete feature.
